Restrictions and requirements
Copyright Disclaimer – Images in the collection of SDASM have been donated or otherwise placed in the care of, and are in the possession of SDASM for intended education and research purposes. In many cases, SDASM has not formally been assigned any rights under the Copyright or other intellectual property laws of the United States or the various states. Therefore, authorization by SDASM for image usage is granted on the understanding that the ultimate responsibility for determining existing and valid copyright or other intellectual property protections lie soley with the applicant and the applicant agrees to hold SDASM harmless for any asserted liability for the applicant’s use. SDASM permission to use an image in its collection is further contingent on attribution that the image comes from SDASM’s collection.
Usage Authorization – Photograph authorization granted by SDASM is for a ONE TIME USE ONLY, for nonexclusive worldwide rights in all languages. Subsequent usage is restricted and requires additional notification and authorization. Such subsequent usage includes, but is not limited to, new editions and new formats not expressly stated in the initial agreement, as well as any and all promotional materials related to the production.
Usage Restrictions – Photographs granted usage authorization by SDASM are not to be used in a manner to imply endorsement by SDASM of any commercial product, service, or enterprise. Usage does not imply that SDASM endorses the manner of usage of an authorized image, the accuracy of the interpretation of the image, nor the accuracy of the text or narration which accompanies the image.
Copy of Publication/Production – As part of the cooperation agreement to authorize use of SDASM photographs, the producer/director/author/publisher will provide a copy of the publication, website, film, etc. within 90 days of public release, at no cost to SDASM, to be held in the Library and Archives of SDASM for the purposes of education and research.
